Acceptable Use Policy (AUP)

Last updated: August 26, 2026

1. Purpose & Scope

This Acceptable Use Policy ("AUP") describes how you may and may not use the Lead Hero platform (the "Service"), with a particular focus on how you contact leads and other individuals through calls, SMS/MMS, and other messaging channels. This AUP is incorporated by reference into, and forms part of, our Terms & Conditions. A violation of this AUP is a violation of the Terms, and the two should be read together. Where this AUP is more specific or more restrictive than the Terms, this AUP controls for questions of acceptable use.

2. Respect for the People You Contact

Lead Hero exists to help you reach real people who are interested in your business. Every person on the other end of a call or message is entitled to be treated fairly, honestly, and with respect. You agree to use the Service only for legitimate, lawful business communications, never to harass, deceive, or take advantage of the people you contact, and never to use the Service in any way that is malicious or intended to cause harm to another person or organization.

3. Prohibited Activities

You may not use the Service, and may not permit anyone acting on your behalf to use the Service, to:

  • Engage in, facilitate, or support any malicious, abusive, harassing, threatening, deceptive, or fraudulent conduct;
  • Send unsolicited communications to any person who has not provided the legally required consent to be contacted, or who has opted out or asked not to be contacted again;
  • Impersonate any person or entity, misrepresent your identity or affiliation, or spoof or falsify caller ID or sender information;
  • Transmit content that is unlawful, defamatory, obscene, discriminatory, hateful, or otherwise harmful to the recipient or to any third party;
  • Distribute malware, attempt to gain unauthorized access to any account, system, or network, or interfere with or disrupt the security, integrity, or availability of the Service;
  • Use the Service for any illegal purpose, including but not limited to scams, phishing, deceptive marketing, or the collection of contact information through unlawful means; and
  • Violate the rights of any third party, including privacy, publicity, or intellectual property rights.

4. Do-Not-Call & Consent Requirements

Before contacting anyone through the Service, you must have the consent or legal basis required for that channel and that recipient. Specifically, you must not contact:

  • Any number listed on the National Do Not Call Registry or an applicable state do-not-call list, unless a legally recognized exemption applies (such as an established business relationship or prior express consent) and you can document that exemption; or
  • Any person who has been added to your own internal do-not-contact list, or who has otherwise told you, verbally or in writing, that they do not want to be contacted again.

You are responsible for maintaining accurate internal do-not-contact records and for suppressing those numbers and addresses across every channel you use in the Service.

5. Calling & Messaging Compliance

Calls and text messages placed through the Service must comply with the Telephone Consumer Protection Act (TCPA), CTIA messaging guidelines, applicable wireless carrier requirements, and any state-specific calling time restrictions or disclosure rules. In particular, you must:

  • Obtain any prior express consent required before placing an autodialed or prerecorded call, or sending an SMS/MMS message, to a wireless number;
  • Honor opt-out requests, including STOP or similar requests, promptly and permanently, and stop contacting that person through the relevant channel;
  • Respect the calling and texting hours permitted under applicable federal and state law; and
  • Ensure your message content and calling workflows accurately identify your business and do not mislead the recipient.

If you send email communications through or in connection with the Service, those communications must also comply with the CAN-SPAM Act and applicable state anti-spam laws, including accurate header information, a functioning opt-out mechanism, and prompt honoring of opt-out requests.

6. Voicemail Drops & Prerecorded Messages

The Service may allow you to deliver prerecorded audio messages directly to a recipient's voicemail box ("voicemail drops") or to place calls that play a prerecorded or artificial voice message. These features carry heightened legal requirements, and you agree that before using them you will:

  • Obtain the prior express written consent required under the TCPA and applicable state law before sending a prerecorded or artificial voice message, or a voicemail drop, to any wireless number, and prior express consent before doing so to any residential landline;
  • Ensure every prerecorded message identifies your business at the outset and provides a working callback number or other means for the recipient to reach a live person;
  • Include a clear and functioning method for the recipient to opt out of future prerecorded messages or voicemail drops, and honor that opt-out promptly and permanently;
  • Never use a voicemail drop or prerecorded message to circumvent do-not-call, consent, or calling-hours requirements that would otherwise apply to a live call to that recipient; and
  • Maintain records sufficient to demonstrate the consent obtained for each recipient of a prerecorded message or voicemail drop, and produce those records to us promptly upon request.

You are solely responsible for the content of any prerecorded message or voicemail drop you send through the Service and for ensuring its use complies with the TCPA, state mini-TCPA statutes, and any carrier requirements applicable to ringless voicemail or prerecorded call delivery.

7. General Legal Compliance

Beyond the specific requirements above, you are responsible for ensuring that your use of the Service complies with all applicable federal, state, and local laws and regulations, and with any industry-specific rules that apply to your business or the leads you contact. You represent and warrant that you have, and will maintain throughout your use of the Service, all consents, permissions, and legal bases required to contact each person in your lead lists through the channel you use to contact them.

8. Monitoring & Enforcement

Lead Hero, Inc may monitor use of the Service for compliance with this AUP and investigate any suspected violation. If we reasonably believe you have violated this AUP or exposed Lead Hero, our carriers, or any third party to legal or regulatory risk, we may suspend or terminate your access to the Service, immediately and without prior notice, remove or block affected content or numbers, and take any other action reasonably necessary to address the violation.

9. Reporting a Violation

If you believe someone is using the Service in a way that violates this policy, or if you have received an unwanted communication sent through Lead Hero, please contact [email protected] with as much detail as possible so we can investigate.

10. Changes to This Policy

We may update this AUP from time to time to reflect changes in the law, carrier requirements, or how the Service is used. If we make material changes, we will update the "Last updated" date above. Your continued use of the Service after changes become effective constitutes your acceptance of the revised policy.
